§1. General Provisions

These Terms and Conditions govern the use of the LoVeLo online store available at www.lovelo.store, including the rules for placing orders, concluding sales contracts, making payments, delivery of Products, exercising the right of withdrawal, submitting complaints, and using the electronic services provided through the Store.

The owner of the online store and the Seller is:

(hereinafter referred to as the "Seller").

These Terms and Conditions are available free of charge on the Store's website in a form that allows them to be viewed, downloaded and stored at any time.

Customers are required to read these Terms and Conditions before placing an order.

By placing an order, the Customer confirms acceptance of these Terms and Conditions.


§2. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

Seller – MB Concept Maria Błaszczak, operating under the LoVeLo brand.

Store – the online store available at www.lovelo.store.

Customer – any natural person, legal entity or organisational unit with legal capacity purchasing Products from the Store.

Consumer – a natural person acting for purposes outside their trade, business or profession.

Business Customer with Consumer Rights – a sole trader who, under applicable law, is entitled to certain consumer rights.

Product – any movable item offered for sale in the Store.

Sales Agreement – a sales contract concluded between the Seller and the Customer through the Store.

Business Days – Monday to Friday, excluding public holidays.


§3. Technical Requirements

To use the Store, the following are required:

  • a device with Internet access;
  • an up-to-date web browser supporting cookies and JavaScript;
  • an active email address.

The Seller makes every reasonable effort to ensure the proper operation of the Store.

Temporary interruptions may occur due to maintenance, servicing or technical upgrades.

The Seller shall not be liable for interruptions resulting from the operation of the Internet, telecommunications networks or equipment beyond the Seller's reasonable control.

§4. Rules for Using the Store

The Customer shall use the Store in accordance with applicable law, generally accepted principles of good conduct, and these Terms and Conditions.

The following actions are strictly prohibited:

  • submitting unlawful or illegal content;
  • undertaking any activity that may disrupt the operation of the Store;
  • using the Store in a manner contrary to its intended purpose;
  • attempting to gain unauthorised access to the Seller's IT systems or infrastructure.

The Seller may temporarily restrict access to selected Store functionalities where necessary to ensure the security or proper operation of the Store.


§5. Product Information

The information presented in the Store, including product descriptions, photographs, technical specifications and prices, constitutes an invitation to enter into a contract within the meaning of Article 71 of the Polish Civil Code.

The Seller makes every reasonable effort to ensure that all information provided is accurate and up to date.

Product photographs are provided for illustrative purposes only. The Seller makes every effort to ensure that they accurately represent the Products offered.

Products made from natural oak may vary in colour, grain pattern, texture and other natural characteristics of the wood.

Such natural variations are inherent to the material and shall not be considered defects of the Product.

Unless otherwise required by applicable law, all prices displayed in the Store are shown in Polish złoty (PLN) and include applicable VAT.


§6. Placing Orders and Conclusion of the Sales Agreement

Orders may be placed through the Store 24 hours a day, 7 days a week.

To place an order, the Customer must:

a) select the Product;

b) add the Product to the shopping cart;

c) provide the information required to complete the order;

d) select the preferred delivery method and payment method;

e) confirm acceptance of these Terms and Conditions;

f) submit the order by clicking the button used to complete the purchase.

Submitting an order constitutes an offer to conclude a Sales Agreement.

After receiving the order, the Seller will send an email confirming receipt of the order.

The Sales Agreement is concluded when the Seller sends the Customer an email confirming that the order has been accepted for processing.

The Seller reserves the right to refuse or cancel an order in the following circumstances:

  • the Customer has provided incorrect or incomplete information;
  • fulfilment of the order is impossible due to circumstances beyond the Seller's reasonable control;
  • an obvious error has occurred in the price or description of the Product.

In such cases, the Customer will be informed of the reason for the refusal or cancellation without undue delay.

§7. Prices and Payment Methods

Unless otherwise required by applicable law, all Product prices displayed in the Store are shown in Polish złoty (PLN) and include applicable VAT.

Product prices do not include shipping costs unless expressly stated otherwise on the Product page or as part of a promotional offer.

The total order value, including the price of the Products and the applicable shipping costs, is displayed to the Customer before the order is placed.

The Seller reserves the right to change Product prices, organise promotional campaigns and introduce special offers. Such changes shall not affect Sales Agreements concluded before the changes become effective.

The Customer may choose from the payment methods available in the Store at the time of placing the order.

The payment methods currently available are displayed during the checkout process before the order is completed.

If payment is not received within the time limit applicable to the selected payment method, the Seller may cancel the order after informing the Customer accordingly.


§8. Order Processing and Delivery

The Seller processes orders within Poland and to other countries where delivery is available.

The standard order processing time is 1–3 Business Days from the date the payment has been successfully received, unless a different lead time is specified on the Product page.

Delivery times depend on the selected carrier and the destination address.

Shipping costs are displayed before the Customer places an order.

Delivery within Poland is free of charge, unless otherwise specified as part of a particular offer or promotion.

For international orders, shipping costs are calculated according to the applicable shipping rates and presented before the Sales Agreement is concluded.

If the delivered parcel shows visible signs of damage, the Customer is encouraged to inspect its contents in the presence of the carrier and, where possible, prepare a damage report. Preparing such a report is not a condition for submitting a complaint but may facilitate the claims process.

If the Seller is unable to fulfil an order for reasons beyond the Seller's reasonable control, the Customer will be informed without undue delay and advised of the available options, including a full refund where applicable.


§9. Right of Withdrawal

Consumers and Business Customers with Consumer Rights may withdraw from a distance Sales Agreement within 14 days of taking possession of the Product, without providing any reason.

To exercise the right of withdrawal, the Customer must submit a clear statement informing the Seller of the decision to withdraw from the Sales Agreement.

The withdrawal notice may be submitted:

The use of the withdrawal form is optional.

The Product must be returned without undue delay and no later than 14 days after submitting the withdrawal notice.

The Customer bears the direct cost of returning the Product unless otherwise required by applicable law or expressly agreed by the Seller.

The Seller will refund all payments received from the Customer, including the cost of the least expensive standard delivery method offered by the Store, no later than 14 days after receiving the withdrawal notice.

The Seller may withhold the refund until the returned Product has been received or until proof of its return has been provided by the Customer, whichever occurs first.

The Customer is responsible for any reduction in the value of the Product resulting from handling the Product beyond what is necessary to establish its nature, characteristics and functionality.

The right of withdrawal does not apply in the cases specified in Article 38 of the Polish Consumer Rights Act.


§10. Complaints

The Seller is liable for the conformity of the Product with the Sales Agreement in accordance with applicable law.

If a Product is found to be non-conforming with the Sales Agreement, the Customer may submit a complaint.

To facilitate processing, the complaint should include, where applicable:

  • the Customer's full name;
  • the order number;
  • a description of the non-conformity;
  • the date on which the issue was identified;
  • photographs supporting the complaint, where helpful.

The Seller will respond to the complaint without undue delay and no later than 14 days after receiving it.

If the complaint is accepted, the Seller will proceed in accordance with applicable law and the Customer's statutory rights.

Nothing in these Terms and Conditions excludes, limits or suspends any rights granted to Consumers or Business Customers with Consumer Rights under applicable law.


§11. Warranty

Products offered in the Store are covered by a warranty only where this is expressly stated in the Product description or in a separate warranty document.

Any warranty provided does not exclude, limit or suspend the Customer's statutory rights relating to the Seller's liability for the conformity of the Product with the Sales Agreement.


§12. Electronic Services

The Seller provides electronic services through the Store, including in particular:

  • browsing the Product catalogue;
  • placing orders;
  • using the contact form, where available;
  • subscribing to the newsletter, where this service is offered.

The use of electronic services provided through the Store is free of charge.

The agreement for the provision of electronic services is concluded when the Customer begins using a particular Store functionality and terminates when the Customer stops using that functionality.

The Customer agrees to use the electronic services in accordance with applicable law, these Terms and Conditions and generally accepted standards of good conduct.


§13. Personal Data

Personal data is processed in accordance with applicable law, including Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and other applicable data protection legislation.

Personal data is processed only to the extent necessary for:

  • processing orders;
  • concluding and performing the Sales Agreement;
  • processing payments;
  • delivering Products;
  • handling complaints and returns;
  • communicating with Customers;
  • complying with legal obligations.

Detailed information on the processing of personal data is available in the Privacy Policy published on the Store's website.

§14. Intellectual Property

All rights relating to the Store and its content belong to the Seller or to third parties from whom the Seller has obtained the appropriate rights.

The following are protected by intellectual property rights, in particular:

  • the LoVeLo logo;
  • Product photographs;
  • Product descriptions;
  • graphic designs;
  • advertising and marketing materials;
  • text published in the Store;
  • the website layout;
  • other elements of the LoVeLo brand identity.

No materials available in the Store may be copied, distributed, published, modified or otherwise used without the Seller's prior written consent, except where permitted by applicable law.

In particular, the use of LoVeLo Product photographs, Product descriptions or marketing materials by other online stores, retailers, marketplaces or third parties without the Seller's prior written consent is strictly prohibited.

Any infringement of the Seller's intellectual property rights may result in legal action in accordance with applicable law.


§15. Product Reviews

Where the Store allows Customers to publish Product reviews, Customers agree to submit reviews that are truthful and based on their genuine experience.

The publication of the following content is prohibited:

  • unlawful content;
  • offensive or abusive content;
  • content infringing the personal rights of third parties;
  • advertising or promotional content;
  • content infringing copyright or other intellectual property rights;
  • content unrelated to the Product.

The Seller reserves the right to remove reviews that violate these Terms and Conditions or applicable law.

The Seller will not remove or modify reviews solely because they express negative opinions, provided they comply with applicable law and reflect the Customer's genuine experience.


§16. Liability

The Seller makes every reasonable effort to ensure that the information published in the Store is accurate, complete and up to date.

The Seller shall not be liable for:

  • interruptions in the operation of the Store caused by force majeure;
  • temporary interruptions resulting from maintenance, servicing or technical upgrades;
  • failures of devices, software or Internet connections beyond the Seller's reasonable control.

The limitations of liability set out in these Terms and Conditions shall not apply where such exclusions or limitations are prohibited by applicable law.

Nothing in these Terms and Conditions excludes or limits the statutory rights of Consumers or Business Customers with Consumer Rights.


§17. Alternative Dispute Resolution

Consumers may make use of alternative methods of dispute resolution and complaint handling in accordance with applicable law.

Information on available alternative dispute resolution procedures may be obtained from, among others:

  • the Polish Office of Competition and Consumer Protection (UOKiK);
  • the competent Regional Inspectorates of the Trade Inspection Authority;
  • municipal and district consumer ombudsmen.

Participation in alternative dispute resolution procedures is voluntary and requires the consent of both parties.


§18. Amendments to the Terms and Conditions

The Seller reserves the right to amend these Terms and Conditions in the event of:

  • changes in applicable law;
  • changes to the scope of the Seller's business activities;
  • the introduction of new payment methods;
  • the introduction of new delivery methods;
  • the addition of new Store functionalities;
  • the need to clarify or update the provisions of these Terms and Conditions.

Any amendments shall not affect the rights arising from Sales Agreements concluded before the amendments take effect.

The current version of these Terms and Conditions is permanently available on the Store's website.

§19. Final Provisions

Any matters not governed by these Terms and Conditions shall be governed by the laws of the Republic of Poland, including in particular:

  • the Polish Civil Code;
  • the Consumer Rights Act of 30 May 2014;
  • the Act of 18 July 2002 on the Provision of Electronic Services;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR);
  • and all other applicable provisions of Polish law.

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms and Conditions become effective on the date they are published on the Store's website.
